Terms and Conditions

General Terms and Conditions (GTC) of Global Academy "c-Wise" UG (limited liability)

1. Scope
These General Terms and Conditions govern the contractual relationship between Global Academy "c-Wise" UG (limited liability) (hereinafter referred to as the "Provider") and persons who participate in the offered online courses, webinars, training programs, or recruitment services, or make use of them (hereinafter referred to as "Participants" or "Clients"). Deviating conditions apply only if expressly confirmed in writing by the Provider.
The Provider's offers are also aimed at Participants residing abroad. The contract language is German. German law applies to all contracts, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Consumers residing in the EU may enjoy additional protection through mandatory provisions of their respective country of residence. The place of jurisdiction is, insofar as legally permissible, the registered office of the Provider.

2. Conclusion of Contract
A contract is concluded through the Participant’s registration via the website, by email, or in writing, and subsequent confirmation by the Provider. Confirmation usually takes place by email. Participants are obliged to provide accurate information.

3. Participation Fees and Payment
The applicable prices for courses, webinars, and seminars are displayed on the website or in the course materials. Payments are due without deduction before the start of the course. The Provider reserves the right to exclude Participants from the course in the event of late payment. Payment can be made via bank transfer, PayPal, credit card, or other specified payment methods.

4. Services and Access
Upon receipt of payment, the Participant gains access to the course content. Access is non-transferable and may not be shared with third parties. The Provider is entitled to block access in case of violations of the terms of use. Third-party providers such as Wix.com, Zoom, Vimeo, or Stripe may be used to deliver the courses.

5. Withdrawal and Cancellation
Consumers have a statutory right of withdrawal of 14 days, provided that no access to digital content has been granted.
For digital content, the statutory right of withdrawal expires before the end of the withdrawal period if the customer has expressly consented to the commencement of performance and confirmed that they thereby lose their right of withdrawal (§ 356 para. 5 BGB). This consent is obtained during the ordering process via a separate declaration.
Cancellations must be made in writing. For paid courses, a processing fee may be charged or the course fee may be forfeited in whole or in part if the cancellation is made at short notice.

6. Rights and Obligations of Participants
The content may only be used for personal, non-commercial purposes. Participants undertake not to infringe any copyrights. The technical requirements for course participation (device, software, internet access) must be provided by the Participant.

7. Copyright
All materials provided are subject to copyright. Distribution, reproduction, or public availability is not permitted without prior written consent.

8. Liability
The Provider is liable only for damages resulting from intent or gross negligence. In cases of slight negligence, liability is limited to breaches of essential contractual obligations. There is no liability for learning success or for technical problems on the Participant's side.

9. Data Protection

10. Cancellation and Changes
The Provider reserves the right to cancel or reschedule events for good cause (e.g., illness, insufficient number of participants). In the event of cancellation without a replacement date, the participation fee will be refunded.

11. Certificates
Participants will receive a certificate after successful completion of the course, provided that this is specified in the course description. Full participation is required.

12. Recruitment Services
Global Academy "c-Wise" UG (limited liability) also offers recruitment services. The subject matter is the placement of applicants (including trainees, professionals, and executives) with companies (Clients). Placement is based on the information and requirements provided by the Client.
The selection of suitable candidates is carried out with care, but no guarantee is given for successful placement. In the event of a successful conclusion of an employment contract between the Client and a referred candidate, a placement fee will be due, the amount of which is based on the contractually agreed gross annual salary.
The fee is payable within 14 days of invoicing without deduction. The Client undertakes to provide the intermediary with all information required for the placement and to inform the intermediary immediately if an employment contract is concluded with a candidate proposed by them.

13. Confidentiality
Both parties undertake to maintain confidentiality regarding all information received in the course of cooperation.

14. Special Conditions for Online Language Courses
For participation in online language courses offered by Global Academy "c-Wise" UG (limited liability), the Terms of Use for German Courses apply additionally, in particular regarding the following points:

  • Deadlines and conditions for booking, cancellation, and rebooking

  • Technical requirements for participation

  • Rules of conduct in the digital classroom

  • Requirements for issuing certificates of attendance or completion certificates

  • Regulations for missed course sessions

The Terms of Use become part of the contract upon course booking. In the event of contradictions between the General Terms and Conditions and the Terms of Use, the more specific Terms of Use shall take precedence.

15. Final Provisions
The law of the Federal Republic of Germany applies. The place of jurisdiction is the registered office of the Provider, insofar as legally permissible. Should any provision be invalid, the validity of the remaining provisions remains unaffected.

The Provider is generally not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
